The properties offered are described as accurately as possible. However, photographs and visual representations are provided for indicative purposes only and shall not have contractual value.
The level of comfort and standard of the properties is assessed according to THE IVORY COLLECTION’s own standards and may differ from local classifications.
The Reservation becomes final upon the cumulative fulfillment of the following elements: express acceptance of these General Terms and Conditions of Sale, validation of specific conditions, payment of the deposit, and written confirmation from THE IVORY COLLECTION.
The Company reserves the right to refuse any reservation for legitimate reasons, in particular in case of doubt as to the identity of the Client or the origin of funds.
Prices are expressed in CFA francs or in foreign currencies depending on the booking channel and include the services expressly mentioned.
Quoted prices are exclusive of tax. Two local taxes are added to the amount of the stay, charged to the Client and remitted by THE IVORY COLLECTION to the relevant authorities: the tourism development tax (TDT), at a rate of two and a half percent (2.5%) of the stay excluding taxes and security deposit, and the municipal tax (TCN), of one thousand (1,000) CFA francs per bedroom per night. These taxes appear separately on every quotation and invoice. THE IVORY COLLECTION does not charge value added tax.
Unless otherwise stipulated, payment shall be made as follows: payment of a deposit corresponding to fifty percent (50%) of the total amount at the time of booking, with the balance due no later than seventy-two (72) hours before the start date of the stay.
During certain specific periods (year-end holidays, school holidays, events, long weekends), stricter payment conditions may apply, including a higher deposit percentage or full advance payment, as specified in the quotation or booking confirmation.
Failure to pay within the required time limits shall result in automatic termination of the contract at the Client’s fault, without prejudice to the sums already paid.
Mobile money or banking transaction fees shall be borne by the Client. In the event of an international transfer, the Client undertakes to anticipate fees and exchange rates so that the net amount received corresponds to the amount indicated in the quotation.
THE IVORY COLLECTION reserves the right to carry out any necessary verification regarding the identity of the payer and the regularity of the transaction.
The Client is required to pay a security deposit, the amount of which is specified prior to the stay. This amount varies depending on the villa reserved and the period, and is communicated in the quotation or booking confirmation.
This deposit is intended to cover any damage, deterioration, loss or breach of contractual obligations. It shall be refunded within forty-eight (48) to seventy-two (72) hours after the Client’s departure, subject to the absence of damage or outstanding amounts.
In the event that damage is identified, THE IVORY COLLECTION reserves the right to retain all or part of the security deposit, upon presentation of supporting evidence.
This amount, which does not bear interest, shall be refunded once the tenant provides proof that:
a. All consumptions for which they were liable and listed in the previous paragraph have been fully paid;
b. No furniture, item or linen is missing, damaged or soiled, or, if applicable, its restoration or replacement with an identical item has been agreed with and accepted by the lessor;
c. The premises have not suffered any damage and are returned in a clean condition (cupboards, bins and refrigerators emptied of waste, sanitary facilities, household appliances, crockery, etc.).
If the security deposit proves insufficient, the tenant hereby undertakes to cover the remaining balance.
The rates applicable to the services offered by THE IVORY COLLECTION may vary depending on the period of stay, in particular due to seasonal factors (high season: October 1st – May 31st; low season: June 1st – September 30th) or event-related factors (school holidays, festive periods, public holidays, high-demand periods).
The applicable price is the one indicated to the Client at the time of booking and confirmed in the contract. No adjustment shall be made after validation of the reservation, unless expressly agreed by the parties or in duly justified exceptional circumstances.
Any request for modification must be made in writing. It shall only take effect after express acceptance by THE IVORY COLLECTION. The Company reserves the right to charge any costs resulting from such modification.
Any reservation is confirmed by the payment of a deposit corresponding to fifty percent (50%) of the total amount of the stay. The consequences of a cancellation by the Client depend on the period of the stay, under the two regimes set out below. The applicable regime is stated on the quotation sent to the Client before any confirmation.
a) Outside peak periods. Cancellation is free of charge up to the fourteenth (14th) day before the arrival date, all sums paid being refunded in full. Between the fourteenth (14th) and the seventh (7th) day before arrival, fifty percent (50%) of the total amount of the stay remains acquired by THE IVORY COLLECTION. Less than seven (7) days before arrival, the full amount of the stay remains due.
b) Peak periods. For stays covering the end-of-year holidays, public holidays and extended weekends, as well as any period expressly designated as such on the quotation, the deposit paid shall remain definitively acquired by THE IVORY COLLECTION whatever the date of cancellation, and no refund shall be granted for a cancellation occurring less than seven (7) days before arrival.

Any occupancy exceeding this number, without prior written authorization from THE IVORY COLLECTION, shall constitute a serious contractual breach.
Consequently, THE IVORY COLLECTION reserves the right to terminate the contract immediately, require the premises to be vacated without delay and without refund of the sums paid, without prejudice to any additional compensation.

The Client shall be responsible for all damages caused by themselves or the Occupants.
An inventory (check-in/check-out inspection) may be carried out upon arrival and departure. In the absence of dispute within twenty-four (24) hours following entry into the premises, it shall be deemed accepted.
The Client undertakes to comply with the following schedule:
Any early arrival or late departure must be subject to prior written agreement from THE IVORY COLLECTION. Additional fees may apply depending on the villa and the period.
In the absence of prior agreement, any occupation beyond the agreed times shall result in the invoicing of an additional night at the applicable rate.

The Company shall not be held liable for technical failures beyond its control.
If, despite the efforts of THE IVORY COLLECTION, several significant malfunctions have affected the course of the stay to the extent of substantially impairing its enjoyment, the Client may submit a written complaint within forty-eight (48) hours following departure.
A commercial gesture may be considered after analysis of the situation and consultation with the Owner of the Property, without this constituting an automatic right for the Client.

In the event of such an occurrence, the performance of the contract may be suspended, postponed, modified or cancelled, without liability for either party.

In return, THE IVORY COLLECTION reserves the right to use, free of charge, photographs and videos of the properties publicly posted by the Client on social media, for communication and brand promotion purposes, unless the Client expressly objects in writing prior to any publication.

In the absence of sufficient history, this amount shall be calculated on the basis of a reasonable estimate of the revenue generated.

This contract is entered into for a minimum duration of twelve (12) months from its effective date.
At the end of this initial period, it shall be automatically renewed for successive periods of six (6) months, unless terminated by either party with a minimum notice period of sixty (60) calendar days prior to the end of the current period.

THE IVORY COLLECTION shall ensure their full execution under usual conditions and shall retain its full remuneration on such reservations.
The Owner expressly undertakes not to interfere with the execution of these stays.
In the event of a serious breach by the Owner of their obligations (unreported unavailability leading to cancellation, unauthorized works during high season, non-compliant property, breach of non-circumvention clause), THE IVORY COLLECTION reserves the right to terminate the contract automatically with a notice period of fifteen (15) days, without prejudice to any claim for damages.
Neither party shall be held liable in the event of occurrence of a force majeure event as defined in Article 1, rendering the performance of the contract impossible.
